GDPR INFORMATION CLAUSES

Ecovis System Rewident Spółka z ograniczoną odpowiedzialnością with its registered office in Warsaw

Pursuant to Articles 13 and 14 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as the “GDPR”), we inform that:

1. Information clause for a Customer and a Contractor of Ecovis System Rewident Sp. z o.o. with its registered office in Warsaw.

 

1.    Your personal data is controlled by Ecovis System Rewident Sp. z o.o. with its registered office in Warsaw, ul. Garażowa 5a, 02-651 Warsaw, entered in the Register of Entrepreneurs kept by the District Court for the capital city of Warsaw in Warsaw, 13th Commercial Division of the National Court Register, under No 0000054522, with the share capital of PLN 250,000.00, Tax ID No (NIP): 5261036755 (hereinafter referred to as the “Controller”);

2.    the Controller’s representative for matters related to personal data protection is Piotr Perłowski, esq., contact: piotr.perlowski@ecovis.pl

3.    The Controller processes your ordinary personal data such as full name and contact details in the form of e-mail address and phone number, address, settlement details, Tax ID No (NIP), Personal ID No (PESEL) and other data necessary for the performance of the Agreement. The data may concern you, natural persons representing your company or natural persons designated by you for contact or service provision purposes.

4.    The Controller informs that your personal data will be processed for the purpose of:

a.      performance of the Agreement, for the term of the Agreement;

b.      compliance with legal obligations to which the Controller is subject (e.g. tax obligations), for a period resulting from the applicable law;

c.       pursuit of legitimate interests of the Controller, such as redress of claims and defence of rights, for not longer than until the expiry of the limitation period provided for in the generally applicable law.

5.    The provision of data is necessary for the conclusion and performance of the Agreement; failure to provide the data may render the conclusion and performance of the Agreement impossible.

6.    You have the right to object to the processing of your personal data, nevertheless, the Controller may possibly still be entitled to continue the processing of data.

7.    Your personal data may be received by entities such as hosting and IT service providers, insurers, law firms, external auditors, post office, couriers, external service providers and other entities, where this is necessary for the purposes set out in section 4.

8.    Your personal data will not be transferred to a third country/international organisation or processed by automated means;

9.    you have the right to lodge a complaint with the President of the Personal data Protection Office if you believe that the processing of your personal data infringes the provisions of the GDPR;

10. In accordance with the GDPR, you have:

a)      the right to access your data and to receive its copy;

b)      the right to rectification (correction) of your data;

c)      the right to erasure; the right to restriction or objection to the processing of your data;

d)      the right to data portability;

 

2. Information clause for persons participating in a recruitment process at Ecovis System Rewident Sp. z o.o. with its registered office in Warsaw.

 

1.    Your personal data is controlled by Ecovis System Rewident Sp. z o.o. with its registered office in Warsaw, ul. Garażowa 5a, 02-651 Warsaw, entered in the Register of Entrepreneurs kept by the District Court for the capital city of Warsaw in Warsaw, 13th Commercial Division of the National Court Register, under No 0000054522, with the share capital of PLN 250,000.00, Tax ID No (NIP): 5261036755 (hereinafter referred to as the “Controller”);

2.    the Controller’s representative for matters related to personal data protection is Piotr Perłowski, esq., contact: piotr.perlowski@ecovis.pl

3.    The Controller processes your ordinary personal data provided by you in the recruitment process, in particular your full name and contact details in the form of e-mail address and phone number, address, as well as skills, interests, licences held, materials which may potentially contain personal data (text documents, diplomas, photographs, etc.).

4.    The Controller informs that your personal data will be processed pursuant to Article 6(1)(a) of the GDPR for recruitment purposes. We may process your personal data on the basis of our legitimate interest for the purpose of the establishment, exercise or defence of claims, if the claims relate to a recruitment process conducted by us We process your personal data for the purpose of recruitment for the job position indicated in the advertisement, for the duration of the recruitment (for not longer than 1 month after the end of the recruitment process), and if you have agreed to participate in future recruitment – for a period of 1 (one) year. We may also keep your personal data for the purpose of the establishment, exercise or defence of claims related to the recruitment process for a period of 3 (three) years after the end of the recruitment.

5.    We process your personal data indicated in the Labour Code or in other specific acts (according to the requirements of the advertisement) on the basis of law and you are required to provide such data if you wish to participate in the recruitment. We process other personal data (e.g. image) on the basis of your freely given consent which you have expressed by sending us your job application; the provision of such data does not affect the possibility to participate in the recruitment.

6.    You have the right to object to the processing of your personal data, nevertheless, the Controller may possibly still be entitled to continue the processing of data. You have the right to withdraw your consent to the processing of personal data, however, in such a case you will not be able to participate in the recruitment.

7.    Your personal data may be received by entities such as insurers, law firms, external auditors, post office, couriers, publishers of job advertisements, providers of recruitment management systems.

8.    Your personal data will not be transferred to a third country/international organisation or processed by automated means;

9.    You have the right to lodge a complaint with the President of the Personal data Protection Office if you believe that the processing of your personal data infringes the provisions of the GDPR;

10. In accordance with the GDPR, you have:

a)      the right to access your data and to receive its copy;

b)      the right to rectification (correction) of your data;

c)      the right to erasure; the right to restriction or objection to the processing of your data;

d)      the right to data portability;

 

3. Information clause for persons contacting (regardless of the contact channels, in particular such as e-mail, the form on the website, telephone, fax) Ecovis System Rewident Sp. z o.o. with its registered office in Warsaw.

 

1.    Your personal data is controlled by Ecovis System Rewident Sp. z o.o. with its registered office in Warsaw, ul. Garażowa 5a, 02-651 Warsaw, entered in the Register of Entrepreneurs kept by the District Court for the capital city of Warsaw in Warsaw, 13th Commercial Division of the National Court Register, under No 0000054522, with the share capital of PLN 250,000.00, Tax ID No (NIP): 5261036755 (hereinafter referred to as the “Controller”);

3.    The Controller processes your ordinary personal data provided by you upon establishment of the contact, in particular data such as full name and contact details in the form of e-mail address, telephone number, address.

4.    The Controller informs that your personal data will be processed pursuant to Article 6(1)(a) of the GDPR, i.e. your consent. We may process your personal data on the basis of our legitimate interest for the purpose of the establishment, exercise or defence of claims, if the claims relate to the established contact. We process your personal data for the purpose of contacting you, responding to questions asked and, possibly, in any process leading to the conclusion of a future Agreement, for a period of 1 year from establishing the contact. We may also keep your personal data for the purpose of the establishment, exercise or defence of claims related to the established contact for a period of 3 (three) years from establishing the contact.

5.    We process your personal data on the basis of your freely given consent which you have expressed by contacting us.

6.    You have the right to object to the processing of your personal data, nevertheless, the Controller may possibly still be entitled to continue the processing of data. You have the right to withdraw your consent to the processing of personal data, however, in such a case no further communication will be possible.

4. Information clause concerning the processing of an image by means of monitoring at Ecovis System Rewident Sp. z o.o.

 

1.        Your personal data is controlled by Ecovis System Rewident Sp. z o.o. with its registered office in Warsaw, ul. Garażowa 5a, 02-651 Warsaw, entered in the Register of Entrepreneurs kept by the District Court for the capital city of Warsaw in Warsaw, 13th Commercial Division of the National Court Register, under No 0000054522, with the share capital of PLN 250,000.00, Tax ID No (NIP): 5261036755 (hereinafter referred to as the “Controller”);

2.        the Controller’s representative for matters related to personal data protection is Piotr Perłowski, esq., contact: piotr.perlowski@ecovis.pl

3.        The Controller informs that:

1)      video surveillance using cameras will be carried out on the premises of the work establishment, i.e. the Controller’s registered seat and offices, due to the legitimate interest of the Controller consisting in ensuring the safety of Employees and other persons staying on the premises of the work establishment, protection of the Controller’s property, controlling the production and maintaining confidentiality of information the disclosure of which could expose the Controller to damage.

2)      The monitoring covers the vision only.

3)      The monitoring does not cover sanitary facilities, changing rooms, canteens, smoking rooms and rooms made available to employees’ representatives.

4)      Monitoring data is stored for 3 months. Where image recordings constitute evidence in proceedings conducted under the law or if the Controller becomes aware that they may constitute evidence in the proceedings, the time limit shall be extended until the proceedings are finally concluded.

5)      After the expiry of the periods referred to in section 4 above, image recordings obtained as a result of monitoring which contain personal data shall be destroyed, unless the law provides otherwise.

6)      The monitoring will be carried out 24 hours a day, 7 days a week.

7)      The Controller shall mark the monitored premises and area in a visible and legible manner, with appropriate signs or sound announcements, not later than one day before the commencement of operation of the monitoring system.

4.        You have the right to object to the processing of your image for the purposes described above for reasons related to your particular situation.

5.        The provision of the image by you is voluntary, but it is a condition for employment, cooperation and use of the services/purchase of the goods of the Controller directly at the Controller’s locations.

6.        Your image recorded in the monitoring system may be made available to recipients such as: security agencies cooperating with the Controller, external law firms, insurers, public entities such as the Prosecutor’s Office, the Police, the Municipal Guard and other entities acting on the basis of applicable laws, as well as to other entities, where this is necessary to fulfil the purpose for which the monitoring has been used.

7.        Your personal data will not be transferred to a third country/international organisation or processed in a manner enabling automated decision-making.

8.        You have the right to lodge a complaint with the President of the Personal data Protection Office if you believe that the processing of your personal data infringes the provisions of the GDPR;

9.        In accordance with the GDPR, you have:

a)      the right to access your data and to receive its copy;

b)      the right to rectification (correction) of your data;

c)      the right to erasure; the right to restriction or objection to the processing of your data;

d)      the right to data portability;

 

5. Additional information.

 

Please do not send us special categories of personal data (such as information about race or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, physical or mental health information, genetic data, biometric data, information about sexual life or sexual orientation and criminal history) via websites or e-mail. If, for any reason, you provide such information, this will mean that you expressly consent to our collecting and using such information in the manner set forth herein or as specified in the place where such information is disclosed.

At the same time, we would like to inform you that “consent”, within the meaning of the GDPR, is a freely given, specific, informed and unambiguous indication of a data subject’s wishes by which he/she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him/her;  The GDPR uses the term “indication of whishes”; such an expression is of key importance, especially in the context of recital 32 of the GDPR, where it is indicated that consent may consist in: (1) ticking a selection box when visiting a website, (2) choosing technical settings to use information society services, and (3) any other statement or conduct which, in a given context, clearly indicates that a data subject has acceptance the proposed processing of his/her personal data. Therefore, when you voluntarily provide us with your personal data, e.g. in the form of an e-mail inquiry, we obtain your consent to the processing of the personal data provided to us.
